US Court Orders Freedom of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks lawful basis.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.
The case originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. After his return to the United States to face human smuggling allegations, he was held in immigration detention.
In her order, the judge pointed out that the government does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The legal challenge center on conflicting claims. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.
